Anwar fails to get sodomy charge dropped

anwar n saiful2 PUTRAJAYA: Opposition leader  Datuk Seri Anwar Ibrahim today failed in his appeal at the Appellate Court in Putrajaya to throw out his sodomy charge.

 

In a unanimous decision, the three-member Court of Appeal panel led by Justice Abu Samah Nordin said the trial should proceed despite the absence of signs of penetration on rectum of the alleged victim Mohd Saiful Bukhari Azlan.

 

Abu Samah ruled that the medical report was not a conclusive evidence and was only corroborative as the court will rely on other evidences such as oral testimony and forensic evidence.IMG_1440B

 

Abu Samah also said Anwar had not shown that the charge against him was oppressive.

 

It was reported that three doctors from Hospital Kuala Lumpur – Mohd Razali Ibrahim, Khairul Nizam Hassan and Siew Seng – had concluded that there were no signs of defensive wounds on Saiful’s body.

 

Anwar was seeking to reverse the High Court’s decision to disallow his application to strike out the charge on the grounds that the charge was actuated with mala fide and was an abuse of the court process.

 

IMG_1441B Following today’s decision however, the sodomy trial which began two weeks ago will resume tomorrow Feb 18 at 9am at Jalan Duta Court.

 

The court also rejected a request  by Anwar’s lead counsel Karpal Singh for a stay of proceedings pending an appeal to be filed in the Federal Court.

 

Anwar is charged with sodomising his former aide at the Desa Damansara condomimium on  June 26, 2008.

 

Outside the courthouse, Anwar told reporters that the judges had "strong excuses."

 

"But it is expected, as it is not easy for them to make firm decision especially when Najib and Rosmah are involved," Anwar told reporters outside the courtroom. I just explained the law and the process. I did not create stories like Utusan IMG_9086BMalaysia, I did not say that it happened on the bed..The problem with Utusan is, they were faking stories without facts and evidence, to tarnish our names," he said.

 

Anwar’s lawyer, Sankara N Nair, said the the defence team had engaged the expertise of some eminent experts, who will give evidence in court tomorrow.

 

He said the experts were DNA specialist Dr Brian McDonald from Sydney Australia, Forensics experts Dr C Damodaran from Chennai, India, and Dr David Wells from Melbourne, Australia.

    it matters not … better for DSAI to be jailed … juz to cfm to the rakyats this is no more than a conspiracy to destabilize the opposition … PR better get the succession line worked out as we all are anxiously waiting for GE13 to come. kick the BN_UMNO gomen out!!!

    Sending Anwar to Sg. Buloh Prison will see UMNO/BN totally defeat in GE13 and PR will win more than 2/3 majority. Malaysians want two party systems not becuase they love or favour PR more. Malaysians want their government to listen to their voices. Now UMNO/BN has stop listening to the voters demand on separation of power on judicary, legislative and election commission. BN need to drive towards the Middle Path and not One Path like lMalaysia. Voters in GE13 will delivery their votes to PR. NST, Star, Utusan and government media will not be able to prevent BN from losing because PR are back from internet news. Voters don’t believe in the current media news which are one sided. Intellectuals need to compare between what is right and wrong before they believe them. BN still treat intellectuals as fools will be sent packing out of Putrajaya in GE13.

    If Anwar is jailed, we could well see the prosecutors and the judges take his place after the 13th GE.

    Since DrM’s time the judiciary in Malaysia is an ass! the MACC, police & judiciary have become the laughing stock of all. If Anuar goes to jail, we might as well burn the ballot paper!
